"STUCK AT PROM®" SCHOLARSHIP
CONTEST OFFICIAL RULES
MUST BE A LEGAL U.S. OR CANADIAN RESIDENT, 14 YEARS OF AGE OR OLDER. VOID IN COLORADO, MARYLAND, VERMONT, PUERTO RICO, THE PROVINCE OF QUEBEC AND WHERE PROHIBITED BY LAW.
TIMING.
The ShurTech Brands, LLC ("ShurTech") "Duck® brand duct tape Stuck at Prom® Scholarship Contest" ("Contest") begins at 12:00:00 p.m. Eastern Time ("ET"),
March 7, 2012, and ends at 12:00:00 p.m. ET, June 13, 2012 ("Contest Entry Period"). Entries submitted online after 12:00:00 p.m. ET June 13, 2012, will not be considered.
SPONSOR.
The Contest is sponsored by ShurTech Brands, LLC, 32150 Just Imagine Drive, Avon, Ohio 44011-1355 ("Sponsor").
ELIGIBILITY.
The Contest is open to legal residents of the United States and Canada, including the District of Columbia, but excluding Colorado, Maryland, Vermont, Puerto Rico and the
Province of Quebec, 14 years of age or older at the time of entry who are attending a high school, home school association or other school-sanctioned prom in 2012, and who
submit their Contest Entry by the deadline. Employees of Sponsor, their family members, and persons living in the same household as employees or their family members are NOT eligible. All federal, state and local laws apply.
AGREEMENT TO OFFICIAL RULES.
Participation in the Contest constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. By entering the Contest, entrant warrants
that the submission is an original work, has not been previously published or won any award, and that Entrant is aware of no conflicting rights in the submission, including but not
limited to copyright or other intellectual property rights as further identified below in the section entitled "No Infringement." Entrants agree that Sponsor, its affiliates, parents,
subsidiaries, agents or contractors and their employees, officers and directors shall not be liable for injury, loss or damage of any kind resulting from participating in this promotion.
NO INFRINGEMENT.
All Entrants, including Entrant Couples, represent, state and agree that their Contest Entry and their Duct Tape Prom Attire will not infringe upon the intellectual property
rights of any third party, including by way of example and not by limitation, any copyright, trademark or patent rights belonging to any third party. With or without copyright/trademark holder permission,
Duct Tape Prom Attire submissions that are believed to copy works of third parties, incorporate works of third parties or are based on works of third parties are subject to disqualification
at the discretion of Sponsor. Entries incorporating Duck Tape® brand duct tape that is printed with licensed and trademarked materials, such as logos, characters, etc., are permitted.
Individual representation of these, or any other copyrighted materials, is prohibited.
PUBLICITY/USE OF NAME AND LIKENESS.
Except where prohibited by law, entry in the Contest constitutes Entrant's consent for Sponsor to use Entrant's name, city and state of residence, Contest Entry, likeness, photograph
and image (collectively, "Publicity Materials") for advertising, publicity and promotional purposes in any media, online or offline, without further permission, consent, payment or other
consideration. Entrant waives any right he or she may have to inspect or approve the Publicity Materials, the advertising or other copy that may be used in connection therewith or the use
to which the publicity materials may be applied. Entrant grants to Sponsor all right, title and interest in any finished photographs, pictures, negatives, reproductions and copies of the
original print, and further grants Sponsor the right to give, sell, transfer and exhibit the print in copies or facsimiles thereof, for advertising purposes, as it deems fit.
HOW TO ENTER.
Contest participants must enter as a couple (two individuals) ("Entrant" or "Entrant Couple"). Each couple must attend a high school, home school association or other school-sanctioned prom
held in 2012, wearing complete prom attire and/or accessories made using Duck® brand duct tape ("Duct Tape Prom Attire"), and submit their Contest Entry by the contest deadline. Other materials, in
addition to duct tape, may be used or incorporated into the design. The prom attire must be an original creation made by the couple, and may not copy, incorporate or be based on the work of a third party –
any entry as such is subject to disqualification at the discretion of Sponsor (see section entitled "No Infringement"). Contest Entries must be submitted online by going to www.stuckatprom.com and submitting
the following: (1) at least one, but up to five, high-resolution color photographs (professional or amateur) of the couple together in Duct Tape Prom Attire, (2) each Entrant's first name, last name, address,
city, state, zip code, phone number, e-mail address, age, high school grade level and the high school where the prom was hosted, and (3) photographer release form if the photo submission is professional (to be
obtained from the photographer and uploaded with entry) (collectively "Contest Entry" or "Contest Entries" as applicable herein). Any Entrant who is a minor must notify his/her parent/guardian, have the
consent of his or her parent/guardian and provide parent/guardian with the option to opt out their entry from admission in the Contest. Incomplete submissions or submissions uploaded outside of the
Contest Entry Period will not be considered. Contest Entries, become the sole property of Sponsor and will not be returned. By submitting Contest Entries, Entrants agree that Contest Entries may be
displayed at the Stuck at Prom website, located at www.stuckatprom.com, as provided in these Official Rules. Mail-in entries will not be accepted.
If you are between the ages of 14-17 years old, you will be required to enter your parent or legal guardian's first name, last name and email address in addition to your own. You will continue
to submit your entry to completion, and an approval email will be sent to the parent or legal guardian confirming your entry with the subject line "Stuck at Prom Contest Parental Consent". The
parent/legal guardian can then elect to opt-out their child and prevent them from entering by clicking the link provided. If a parent does not elect to opt-out their child, the entry submitted
will be accepted. A parent can opt-out their child at any time during the Promotion Period.
When your entry is received, you will be notified via e-mail. After a moderation period, you will receive an e-mail notification that your submission has been accepted or denied. Please do not call
or e-mail prior to three weeks passing. Online viewing of the Contest Entries will begin upon receipt and acceptance of the first contest entry, and will be posted indefinitely.
LIMIT ONE CONTEST ENTRY PER ENTRANT COUPLE.
Subsequent submissions made by the same Entrant Couple will NOT be considered. Sponsor is not responsible for incomplete, invalid or illegible submissions, which will be disqualified.
Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the operation of the Contest, is acting in violation of these Official Rules,
whose Entry contains profanity or other offensive depictions, or that in any way may defame or jeopardize the goodwill or reputation of Sponsor or any third party. Entering the contest
and uploading an image does not guarantee that the Contest Entry will be posted to the website or admitted for consideration. Sponsor's determination to deny a Duct Tape Prom Attire
submission is binding and final.
CONTEST ENTRIES
Contest Entries become the sole property of Sponsor and will not be returned. By participating in the Contest, Entrant grants to Sponsor the non-exclusive, irrevocable worldwide right
to use, publish and copy the Contest Entry in any media, in whole or in part, without geographical limitation or compensation to Entrant, including by way of example and not by limitation,
display on the Stuck at Prom website, located at www.stuckatprom.com. Sponsor reserves the right to request Top 10 finalist Duct Tape Prom Attire upon completion of the Contest at no further
compensation to the Entrant Couple. In such case, Sponsor will provide pre-paid overnight courier instructions for shipment of the attire.
JUDGING CRITERIA/OVERALL AWARDS.
All Contest Entries, including photographs, will be judged collectively according to the same judging criteria by a panel of judges selected by Sponsor. Using the following criteria
("Judging Criteria"), judges will select ten (10) Finalist Couples, who will move on to a period of online public voting:
- Workmanship (30%)
- Workmanship will be judged based on the quality, neatness and attention to detail given in creating the Duct Tape Prom Attire and accessories.
- Originality (25%)
- Originality will be judged based on the uniqueness, inventiveness, creativity and original thought of the Duct Tape Prom Attire and accessories.
- Use of Color (25%)
- Use of Color will be judged based on the combination, integration and harmony of colors used to create the Duct Tape Prom Attire and accessories.
- Accessories (10%)
- Accessories will be judged based on the creativity and use in accentuating and completing the Duct Tape Prom Attire.
- Use of Duct Tape (10%)
- Use of Duct Tape will be judged based on how duct tape is used to construct the pieces of the Duct Tape Prom Attire and accessories.
Judges will select the 10 Finalist Couples at 12:00:00 p.m. ET on June 15, 2012, at ShurTech Brands, LLC, 32150 Just Imagine Drive, Avon, Ohio USA. The decision of the judges is final and binding.
Those 10 Finalist Couples will be posted online for public voting. The online voting period ("Voting Period") will begin at 12:00:00 p.m. ET on June 18, 2012, and end at 12:00:00 p.m. ET on
July 11, 2012. Anyone visiting the www.stuckatprom.com website during the Voting Period is eligible to vote. In order to vote online, voters will be required to complete a brief survey and provide
the e-mail address from which they are voting prior to placing one vote for a top 10 finalist ("eligible voters). Eligible voters may vote for the Finalist of their choice by applying the judging
criteria stated above. Online voting is limited to one vote per person or e-mail address per day. Multiple votes per e-mail address on the same day will not be counted. Those ten (10) Finalists'
entries will also be re-scored by a panel of judges selected by the Sponsor and their scores will be combined with the results of the public voting,with the panel of judges accounting for 60% of the
Final score and the public voting accounting for 40% of the Final score. The three Contest Entries that receive the highest Final scores will be awarded the top three (3) Prizes. The couple receiving
the highest Final score will be awarded First Place, the couple receiving the second highest Final score will be awarded Second Place, and the couple receiving the third highest Final score will be
awarded Third Place. The remaining seven couples in the top 10 finalists will each be awarded with the Runners Up Prizes.
Winning is contingent upon fulfilling all requirements of these Official Rules and Sponsor's decisions as to the administration of the Contest and prize awards are final. Sponsor will notify the Potential
Winners on or about July 12, 2012, in accordance with the information provided by Entrant Couples in the Contest Entries. In the event that an Entrant's phone number or e-mail address changes, it is Entrant's
responsibility to notify Sponsor of such change. Potential Winner – or where Potential Winner is a minor, his or her parent or guardian – must sign and return an Affidavit of Eligibility and Release
(except where prohibited by law) via pre-paid overnight courier within Seven (7) days of receipt of those documents or prize may be forfeited. Noncompliance with this time period may result in
disqualification and prize forfeiture. In the event that any prize notification is undeliverable, Sponsor is unable to contact a Potential Winner, or response to a prize notification is not received
within seven (7) days of its issuance, the prize may be forfeited. Where a prize is forfeited, the Entrant Couple with the next highest online vote total in accordance with the Judging Criteria will
be chosen as an alternate winner. The winning couples will be announced by news release and will be posted on the www.stuckatprom.com website on or about July 13, 2012.
TIES.
In the event of a tie score between two or more Entrant Couples, the tied Entrant Couples will be asked to provide a written answer to the following question ("Tie Breaker Question"):
- How do you plan on using Duck® brand duct tape in college?
The answer to the Tie Breaker Question should be no more than 150 words in length and will be judged based on originality and creativity. Answers more than 150 words in length will be disqualified.
Tie Breaker answers should be sent via email to an email address that will be provided by Sponsor upon notification of the Entrant Couples.. Tie Breaker answers must be submitted by Entrant
Couples within three (3) days of notification by Sponsor. Tie Breaker answers not received within the three day period, will disqualify the Entrant Couple.
PRIZES.
Overall First Prize: Each individual member of the First Place winning couple will receive a cash scholarship of $5,000.00. The school that hosted the First Place winning couple's prom will
receive a cash prize of $5,000.00. Overall Second Prize: Each individual member of the Second Place winning couple will receive a cash scholarship of $3,000.00. The school that hosted the
Second Place winning couple's prom will receive a cash prize of $3,000.00. Overall Third Prize: Each individual member of the Third Place winning couple will receive a cash scholarship
of $2,000.00. The school that hosted the third place winning couple's prom will receive a cash prize of $2,000.00. Overall Runners Up Prizes: Each individual member of the Runners Up winning
couples will receive a cash prize of $500.00. The schools that hosted the runners up winning couples' proms will receive a cash prize of $500.00.
Additionally, six winners will be given "Honorable Mention" Awards in the following accessory categories ("Honorable Mention Winner"):
- Best purse
- Best corsage
- Best shoes
- Best tie
- Best jewelry
- Best prop
The same sponsor-selected panel of judges that determines the Top 10 Couples will choose Honorable Mention Winners. Judges will use the same judging criteria to determine the Honorable
Mention Winners: workmanship, originality, use of color and use of duct tape. Couples that have already been chosen as a Top 10 Couple will be ineligible to receive an Honorable Mention Award. The decision of the judges is final and binding
Each Honorable Mention Winner will receive a Duck® brand duct tape prize package, which contains thirty (30), 10-to-20 yard rolls of color and printed Duck® brand duct tape (colors and
prints to be chosen by Sponsor) and a Stuffed Trust E Duck character (Approximate retail value $154.70). The total value of all prizes is $42,356.40. All prizes will be awarded provided
there are a sufficient number of eligible entries received. Where winner is a minor, prize will be awarded in the name of the parent or guardian as custodian for the minor under the Uniform
Transfers to Minors Act or similar applicable legislation. No substitution or transfer of prizes is permitted. All taxes are the sole responsibility of the prize winners. Where prize is
valued at over $600, Sponsor will report the prize on IRS Form 1099 as required by law.
TERMS AND CONDITIONS.
Participation in the Contest constitutes Entrant's full and unconditional agreement to and acceptance of these Official Rules. Sponsor reserves the right in its sole discretion to
disqualify any Entrant it finds to be tampering with the operation of the Contest or to be acting in violation with these Official Rules. Entrants agree that Sponsor, its affiliates,
parents, subsidiaries, agents or contractors and their employees, officers and directors shall not be liable for injury, loss or damage of any kind resulting from participation in this Contest.
Winning is contingent upon fulfilling all requirements of these Official Rules and Sponsor's decisions as to the administration of the Contest and prize awards are final. Sponsor reserves
the right, in its sole discretion, to cancel, modify or suspend the Contest should fraud, technical failures, or any other factor beyond the reasonable control of Sponsor impair the integrity
of the Contest, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award prizes based on the Judging Criteria from the eligible Contest Entries
received up to the time of impairment. Sponsor, its respective affiliates, parents, subsidiaries, agents and employees are not responsible for late, lost, illegible, incomplete, stolen,
misdirected, illegitimate or impermissible submissions; or any other error whether human, mechanical or electronic. Proof of submitting a Contest Entry will not be deemed to be proof of receipt by Sponsor.
Entrant, on behalf of himself or herself and his or her heirs, assignees, executors and administrators, agrees: (i) that the decisions of Sponsor shall be final in all respects, including,
without limitation, all decisions regarding eligibility, Contest entry compliance with the Official Rules, judging, judging criteria, verification of winners, award of prizes and general
administration of the Contest; and (ii) to release and to hold harmless Sponsor, its parent, subsidiary and affiliated companies, prize suppliers, advertising and promotion agencies, and independent
contractors and their respective officers, directors, shareholders, members, agents and employees ("Released Parties") from all liability, loss, claims, causes of action, use of Publicity Materials or
damage to reputation of any kind attributable in whole or in part, directly or indirectly, to Entrant's participation in the Contest or acceptance and/or use of any Prize. In addition, Entrant agrees to
indemnify and hold harmless the Released Parties against any loss, damage or expense, including court costs and reasonable attorneys' fees, that any of them may suffer as a result of any act or omission of
Entrant in connection with this Contest, Entrant's receipt of any prize award, and any representations made by Entrant by accepting these Official Rules. Entrant agrees to return or forfeit any prize award,
as the case may be, if any representation made by Entrant in these Official Rules is false.
Except where prohibited, Entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Contest shall be resolved exclusively by arbitration pursuant to the
Rules of the American Arbitration Association then in effect, AND ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED BY ENTRANT WITH REGARD TO THE CONTEST, AND
IN NO EVENT SHALL INCLUDE ATTORNEYS' FEES, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES. All issues and questions concerning the construction, validity, interpretation and enforceability of these
Official Rules, or the rights and obligations of Entrants and the Released Parties in connection with this Contest, shall be governed by and construed in accordance with the laws of the State of Ohio,
without giving effect to any choice of law or conflict of law rules or provisions (whether of Ohio or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Ohio.
PRIZE WINNERS AND OFFICIAL RULES.

results will be available within 20 days after the close of the Contest Period.
